Service Agreement

Please read this Service Agreement carefully before using the services provided by REXE Teknoloji A.S. Placing a service order means that the agreement, together with all its articles and annexes, has been read and accepted.

1. Parties and Subject of the Agreement

This agreement is concluded between REXE Teknoloji A.Ş. (hereinafter "REXE"), operating at Kızılırmak Mah. Dumlupınar Bulv. No: 3C1-160 Çankaya/Ankara, and the natural or legal person purchasing products and services via rexe.tr (hereinafter the "Customer").

This agreement covers the terms of use for all IT services such as VDS/VPS (virtual servers), physical (dedicated) servers, server hosting, game servers, software, licensing, backups, IP address leasing, DDoS protection and similar services.

The parties accept and undertake the accuracy of the information declared in this agreement. The general terms of use, privacy policy and refund terms are integral annexes to this agreement.

2. Acceptance of the Agreement

By receiving services from REXE, the Customer accepts and declares that they have read this agreement, understood all technical and legal terms, and have sufficient information about the nature of the service.

Placing a service order means that the agreement, including all of its articles and annexes, has been read and accepted.

3. Account Creation, Accuracy of Information and Notifications

It is the Customer's responsibility to enter registration details such as name, surname, national ID/tax number, e-mail and phone correctly and keep them current. An actively used e-mail address and phone number must be provided.

All e-mails and SMS messages sent by REXE are deemed to have reached the Customer. REXE is not responsible for consequences arising from contact details not being kept current or notification permissions not being active.

If suspicious activity is detected on the account, REXE may suspend the service until identity verification is completed.

4. Order, Setup and Delivery

Orders are processed after payment is completed and fraud checks are performed. For payments by virtual POS, virtual servers are set up automatically within minutes; for technical or security reasons this may take up to 24 hours at most. For other services, setup takes up to 72 hours at most.

For payments by wire transfer/EFT, the payment confirmation period is at most 1 business day. Unless otherwise stated, software and license services are delivered within 7 days at the latest.

If delivery is not made within the stated periods, a refund is issued upon the Customer's request.

5. Rights and Obligations of the Parties

The services ordered by the Customer are provided by REXE on condition that the relevant fee is paid. REXE has no obligation to provide service until the service fee is collected.

The security of server access credentials and passwords belongs to the Customer; the Customer is responsible for damages arising from sharing or losing this information.

Pursuant to Law No. 5651 and related legislation, REXE, as a hosting provider, is not obliged to monitor hosted content in advance or investigate unlawfulness; the Customer is solely responsible for the content.

6. Service Scope and Restrictions

REXE provides virtual server (VPS/VDS), physical server, server hosting, game server and DDoS protection services. Services may only be used in line with the category and purpose selected at the time of order.

REXE does not provide services to hosting companies (resellers reselling under sub-dealership) or TeamSpeak 3 (TS3) servers. Services found to be used for these purposes may be suspended or terminated without refund.

In case of use beyond the intended purpose, or excessive or abusive use of resources, REXE may warn the Customer or temporarily suspend the service without notice.

7. Server Use and Unmanaged Service

All data, software and configuration on the server are the Customer's responsibility. Unless agreed otherwise in writing, all server services are provided as "unmanaged".

The management, updating, security and continuity of the operating system, control panel, applications, services, databases, security configurations, user operations and all software components on the server belong to the Customer.

8. Licensing and Software

Licensing of the operating system and third-party software is the Customer's responsibility. REXE is not responsible for legal and technical consequences that may arise from the use of unlicensed software.

All damages arising from the IP address being blacklisted as a result of unlicensed use belong to the Customer.

9. Resource Use and Performance

For virtual server services, a fair-use limit of 1 GHz is applied per purchased CPU core (e.g. 8 Core = 8 GHz). Hardware resource overuse that may affect other services is prohibited.

Physical server services are delivered with the Core Performance Boost (CPB) feature disabled by default. It can be activated for an additional fee upon the Customer's request; monitoring any thermal changes after activation is the Customer's responsibility.

If use that adversely affects infrastructure stability, network performance or the service quality offered to other customers is detected, REXE reserves the right to reduce port speed, limit resource use, temporarily suspend or terminate the service without prior notice. Assessment is based on REXE's technical measurements and system records.

10. Operating System Installation and IP Change

For operating systems installed automatically via the panel, the OS may be changed at most 15 times within 30 days. For manually installed operating systems, the first installation request made at the time of order is free; a fee may be charged for exceeding the limit or for reinstallation requests.

A one-time IP change may be made after evaluating the technical justifications stated by the Customer. REXE may charge a fee for the IP change.

11. Traffic, Fair Use and Internet Usage Rights

Servers have symmetric physical connectivity of at least 1 Gbit/s and at most 10 Gbit/s. REXE is not responsible for different results obtained in speed tests due to infrastructure-related reasons.

The term "unlimited traffic" means that the traffic used is not measured on a TB basis and that no quota is applied at any point in standard operation. In ordinary download/upload operations you can operate at the full speed of your port capacity. Unused traffic does not carry over to the next month.

Your bandwidth usage is assessed using the PERC95 (95th percentile) measurement method, in which the highest 5% of bandwidth samples over a given period are disregarded and the peak of the remaining values is taken as the basis. When system records show that your sustained usage stays at or above 15 Mbit/s under this measurement, an additional usage (overage) fee may be billed to you in line with the fair use principle, or your service may be temporarily paused. Any detected overage is not included in the standard service fee and is billed separately.

Momentary, short-lived traffic spikes are excluded from this assessment; what is taken into account is the average line consumption that persists throughout the period. Additional capacity must be purchased for usage that requires continuously high bandwidth.

12. IP Geolocation and Location

Services are hosted in the data centers with which REXE has agreements. The organization, country or city information shown for your assigned IP address in lookup services may not match the data center location where the server is physically located.

A difference in IP geolocation information does not change the physical hosting location of the service and does not, on its own, constitute grounds for a refund, withdrawal or compensation.

13. IP Allocation, Record Retention and Liability for External Attacks

Allocated IP addresses and servers are associated with the Customer's identity information. Traffic, access and transaction logs are retained for the periods required by applicable legislation and may be shared upon a duly submitted request from competent authorities.

The Customer is solely responsible for any unauthorized access, attack, fraud or unlawful act carried out through the IP addresses or services allocated to them. In such a case, REXE reserves the right to identify the relevant Customer based on allocation dates and system records and to initiate legal proceedings.

14. Transfer of Account, Credit and Service

Accounts, services or site balance cannot be transferred between customers. A Customer who shares account access information with third parties is personally responsible for all transactions and consequences arising from such sharing.

Site balance credited to your account as a result of a refund or cancellation cannot be converted into cash, foreign currency or any other value; it may only be used to purchase new services from REXE or to extend the term of an existing service. REXE cannot be held responsible for grievances arising from the transfer of accounts, credit or services between customers.

15. SMTP / Mail Policy

SMTP ports are closed by default. A support request must be opened for mail sending and the policy terms must be accepted.

In cases of spam, abuse, blacklisting, phishing, malicious traffic or suspicion of bulk mailing, REXE reserves the right to close the relevant ports, stop the IP announcement, and suspend or terminate the service. REXE is not responsible for indirect damages such as loss of access, delivery, revenue or reputation arising from these reasons.

16. DDoS Protection

DDoS protection provided by REXE does not carry a 100% protection guarantee; measures are intended to protect the internet backbone and overall infrastructure integrity and do not guarantee uninterrupted access for a specific service, port, protocol or application.

REXE may develop custom filters for the Customer to the extent supported by the infrastructure; where the infrastructure is not suitable, filtering may not be developed and the Customer cannot exercise a right of withdrawal for this reason. The Customer accepts that complex attacks, force majeure or operator-related network outages may occur.

17. Backup and Data Loss

Automatic backup is provided for virtual server services; for physical servers it can be included in the backup service with the Customer's additional order. Unless explicitly stated otherwise, the Customer is obliged to periodically back up their data independently.

Since backup systems run once a day by default, there may be hourly or daily differences when restoring from a backup. REXE cannot be held responsible for damages that may arise because the integrity of backups is not checked manually.

REXE is not responsible for data loss resulting from disk failure, RAID corruption, file system errors, user operations, malware or third-party intervention, and provides no data recovery guarantee under any circumstances.

18. Service Continuity (Uptime)

REXE aims for high availability thanks to the redundant infrastructure of the data centers it is connected to. Planned maintenance work is included in the availability calculation and is announced in advance as much as possible.

19. Support Scope and SLA

Support is provided only through the customer panel, and responsibility is limited to the continuity of the server's physical infrastructure. The operating system, control panels, applications and third-party software; and operations such as software installation, configuration, optimization, debugging and data recovery are outside the standard support scope.

For extended support, an SLA (Service Level Agreement) is offered for an additional fee; unless committed in writing, no guarantee of intervention, resolution or response time is given. 24/7 support is not a guarantee of instant response; response time does not exceed 24 hours except in exceptional cases.

If the same or similar requests are submitted frequently and create an operational burden, REXE reserves the right to charge a fee, apply a transaction limit or reject the request.

20. Pricing, Payment and Renewal

The service fee is the amount shown at the time of order and is collected VAT included. REXE works with a prepaid service model and reserves the right to change prices without prior notice due to changes in inflation, energy, license, hardware and supply costs; changes are applied in the next renewal period.

To extend the service period, the relevant fee must be paid before the period ends. If the renewal invoice is not paid, the service is kept suspended for 3 days; if no payment is made at the end of this period, the service and its backups are permanently deleted and cannot be recovered. REXE has no obligation to send payment reminders.

21. Security Policy and Intervention

In cases of abuse reports, legal applications, security risks, spam, attacks, malicious traffic, unauthorized access attempts or extraordinary situations affecting other customers, REXE may perform the necessary technical and administrative intervention without prior notice.

Within this scope, the service may be suspended, restricted, shut down, IP routing may be stopped, ports may be closed, or the service may be terminated entirely. In such a case, REXE has no obligation to obtain prior approval, hand over data or keep the service active.

22. Acceptable Use Policy (AUP) and Prohibited Content

The Customer may not use REXE services for any illegal, harmful or unauthorized purpose (Acceptable Use Policy — AUP). If an AUP violation is detected, REXE may suspend the service or terminate the agreement without prior notice; no refund is made in such a case.

DDoS, spam, proxy, erotic/pornographic content, illegal software, mining, brute-force and illegal broadcasts are prohibited (this list is illustrative and not limiting). If detected, the service is stopped or terminated without refund, and notification is made to the competent authorities where necessary.

The Customer accepts that all administrative sanctions, judicial proceedings, compensation, costs, attorney fees and other damages arising from their own use belong to them. Copyright and trademark infringement notices are received through the support system.

23. Contract Term, Suspension and Termination of Service

This agreement enters into force on the service start (activation) date and continues throughout the renewal periods unless duly terminated by one of the parties. When the Customer wishes to end their service, they must give written notice through the customer panel at least 15 days before the end of the current period.

In case of payment problems or breach of contract, REXE reserves the right to stop all or part of the services. REXE has the right to unilaterally terminate the agreement in the event of an AUP (Acceptable Use Policy) violation or a change in the terms of the agreement. In case of insult or rude behavior toward REXE staff, the service may be terminated without refund.

REXE reserves the right to not establish a service relationship with a customer, reject an order or terminate an existing service without giving any reason. If the suspension continues beyond the specified period, REXE may unilaterally terminate the agreement.

24. Refund and Right of Withdrawal

The Customer may create a cancellation request through the customer panel within 3 business days of the service being activated (delivered). Once the cancellation is approved, the payments subject to refund are made within 30 business days at the latest. VAT and bank/transaction charges may be deducted from the refund amount.

There is no right of refund for VDS / virtual server, server hosting and physical (dedicated) server rental services. Domain names, licenses, custom configurations, manual installations and services involving third-party supply, as well as promotional/discounted services, are also outside the scope of cancellation, withdrawal and refund.

No refund is made in the event of an AUP violation or the justified termination of the agreement. Refunds are made only to an IBAN matching the account identity or to the site balance.

25. Limitation of Liability

Except in cases of intent or gross negligence, REXE is not responsible for any damages including service interruption, performance degradation, data loss, revenue loss, profit loss, reputation loss, third-party claims and indirect damages.

The total amount for which REXE may be held liable for any reason is limited to the amount paid by the Customer in the last invoice period for the relevant service.

26. Hardware Failures and Force Majeure

In physical server services, delays may occur due to hardware failures, part replacement, manufacturer/supplier procurement processes, data center operations and maintenance work. REXE is not responsible for indirect damages that may arise from these processes.

Natural disasters, fire, earthquake, war, terrorism, civil unrest, strikes, cyberattacks, operator outages, data center failures, power outages, administrative/legal decisions and similar events beyond REXE's reasonable control are considered force majeure. During force majeure, REXE cannot be held responsible for the failure to perform the service.

27. Records and Evidence Agreement

REXE's system records, traffic records, billing records, support records, logs and electronic records are accepted as conclusive evidence in disputes that may arise between the parties.

28. Amendments, Competent Court and Final Provisions

REXE reserves the right to change and update the terms of this agreement, the service scope and its policies without prior notice. Changes take effect from the date they are published on rexe.tr and are binding on the Customer.

By continuing to use the service, the Customer is deemed to have accepted the current terms of the agreement; if they do not accept the changes, they have the right to terminate their service.

In the resolution of disputes arising from this agreement, the Courts and Enforcement Offices of Ankara (Çankaya) are competent. Rights arising from consumer legislation are reserved.
